The Speed Giveaway

NO PURCHASE OR CONTRIBUTION NECESSARY. A PURCHASE, CONTRIBUTION, DONATION, OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility
The Speed Giveaway (the “Promotion”) is open only to legal residents of the fifty (50) United States (including District of Columbia, excluding Florida, New York, Rhode Island) who are thirteen (13) years of age or older at the time of entry. Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees of Raffstar, LLC, or any of its respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s (or if you are a minor in your jurisdiction of residence, your parent/legal guardian’s) full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a sweepstakes (the “Sweepstakes”).

2. Sponsor
The Sponsor of the Promotion is Raffstar, LLC, which is located at 1002A S. Mingo Road, Suite 256, Tulsa, Oklahoma 74133.

3. Timing
The Promotion begins on 7/6/2009 3:00 pm ('ET') and ends on ticket number 100000 (the “Promotion Period”). Sponsor’s computer is the official time keeping device for this Promotion.

4. How to Enter
During the Promotion Period, go to www.raffstar.com, fill out the online register form completely by providing your name, email address, the zip code where you live, date of birth, and gender you will also be asked to create a screen name and password and submit the form. Once you have submitted the form, you will be directed to a web page where you click on “enter/get ticket.” By clicking on “enter/get ticket” you have entered the sweepstakes... Limit: Limit one entry per person every one (1) hour during the Promotion Period. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant’s plays and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. All entries become the sole and exclusive property of Sponsor and will not be returned. Sponsor reserves the right to contact entrants and all other individuals whose email address is submitted as part of this promotion.

5. Winner Selection:
On or about ticket number 100000, Sponsor or an independent judging agency will select entries for the prize described below in Section 8 in a random drawing of all valid entries received. The entrant will be contacted using the email address provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules.) Sponsor’s decisions as to the administration and operation of the Promotion and the selection of potential winners are final and binding in all matters related to the Promotion. Winners will be notified by email on or about ticket number 100000.

6. THE POTENTIAL SWEEPSTAKES WINNER IS SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.

7. Verification of Potential Winner
Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email, after the date of random drawing. The potential winner must assert his/her claim to the prize by responding to the email from the Sponsor indicating he/she is the winner within one (1) hour after receiving the email notification. If the potential winner does not claim the prize within one (1) hour, another potential winner will be selected and will be notified that he/she is the potential winner. Until a potential winner asserts his/her claim to the prize within one (1) hour of being notified that he/she is the potential winner, the Sponsor will continue to randomly select potential winners as described in Section 5 above. After a potential winner asserts his/her claim to the prize, potential winners have to submit official name and shipping information. Potential winner of total prize values at $600 or more (or if you are a minor in your jurisdiction of residence, your parent/legal guardian) will be required to sign and return to Sponsor, within fifteen (15) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner of a sweepstakes prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Any prize won by a participant who is deemed a minor in his/her jurisdiction of residence may be awarded to a parent or legal guardian of such minor on the minor’s behalf.

The Xbox 360 is provided “as is” with no warranty of any kind, express or implied. The Odds of winning depend on the number of eligible entries received during the Promotion Period. No cash equivalent for any prize, prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. [If car: Winner will be required to present a valid driver’s license and proof of insurance before the car will be awarded]. The Xbox 360 has a current Approximate Retail Value of $299.99. Any prize won by a participant who is deemed a minor in his/her jurisdiction of residence may be awarded to a parent or legal guardian of such minor on the minor’s behalf.

9. Entry Conditions and Release
By entering, each participant (or if you are a minor in your jurisdiction of residence, your parent/legal guardian) agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and/or the Sweepstakes judges which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsor and its respective parents, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes and Promotion, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes and Promotion, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsor from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Sweepstakes and Promotion and/or entrant’s acceptance, use or misuse of prize.

10. Publicity
Except where prohibited, participation in the Promotion constitutes winner’s (or if you are a minor in your jurisdiction of residence, your parent/legal guardian’s) consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

11. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

12. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes play, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

13. Disputes
Entrant (or if you are a minor in your jurisdiction of residence, your parent/legal guardian) agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Missouri State Court located in Kansas City, Missouri; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses , and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri. {jurisdiction subject to change}

Request the winner list from "179174089 Promotion"; request must be received by 01/28/2010 11:47 pm ('ET'). Vermont residents may exclude return postage.

@ryuushinobi08 In the "specifications" section it lists a 60 gig harddrive and calls it the "pro" model.

@jefferyheinen The Wii is cheap and backwards compatible with the gamecube so you can sell that to afford the Wii, that's what I'd suggest you go for.

Too bad a few greedy individuals are trying to ruin the site for everyone else by monopolizing the top 10 board of every prize. Management needs to get a clue and get rid of the top 10 board if they can't or won't limit the total number of entries we can each get. Otherwise this site, due to discouragement, is going to start losing participants and ultimately the advertisers.

Agreed with Channce... It really discourages people to join raffstar (and stay with it) when they see the same 10 people EVERY single time. I work. I cannot be on this all day and all night. I suppose with the verification system it will help with the bot entries I guess. (notice I said help... lol)

A few things to note regarding the comments. We do have a verification system in place and we are very aware when someone is trying to use a bot to cheat the system.

Regarding the leader board, it is all based on your outlook, sure it could be "discouraging" to see the same people on the top 10, but there is always a flip side how about the fact that those people rarely win? If you change your view point the leader board is actual "very encouraging" to know that even if your not in the top 10 in tickets you can still win.

Finally remember that Raffstar is in beta and has only been live for 9 months. What you are currently participating in is literately the tip of the iceberg when it comes to the future plans and features for the site.

like i said before, your odds of winning don't change just because someone else has more tickets. the only thing that matters is the number of ticks you have.

if everyone had one ticket, your odds of winning would be 1 in 150,000. if you were the only person with one ticket, and one other person has the rest of the tickets, your odds are still 1 in 150,000.

I just wanted to say that IF someone will put in the time and the effort to get a ticket every hour on the hour....then THEY certainly deserve the better odds....althouth if YOU will check the winners page...you will see that people have actually won that only have gotten ONE ticket so GO figure right...?

Since there are a limited number of tickets, some jerk like me with no job and insomnia reduces the time normal folk have for getting tickets, so I do understand the frustration. I used to have it, still do, actually. :-)

I received the winning ticket once, but I wasn't home to claim it since it was Veteran's Day, so oh well.

As far as changes one could make, making more, once per day prizes would help, also limiting people to two prizes per a certain period would prevent anyone from winning too much while making everyone willing to enter for the small stuff. If it were one prize per period some people wouldn't go for the small stuff in case they win that and then can't possibly win something like the blu-ray player. Any other ideas on how to improve the site?

I'm all good with there being a max number of tickets each day for each raffle. I'm also good with proving my identity to administration to help make sure that no one is holding multiple accounts. I'm sure anybody that is honest would have no problem with that.

Also, how many winners from this year are going to want to claim the blu-ray? It puts all of them over the $600 mark and they'll have to fill out and notarize a winner's affidavit. Who likes dealing with the I.R.S.? If someone new wins, are they going to want to claim anymore prizes this year?

If his 360 broke, you should contact M$'s warranty department. They have extended the warranty on the consoles due to the red-ring-of-death issues. Unless it's like my friend's broken 360 which was more user-error.

I'm currebtly 88th with 169 tickets. I get one or 2 tickets a day. I checked my tickets and there seem to be a lttle over 300 tickets taken on this prize every 12 hours. There are about 6330 members.
The number grows at around 2 or 3 a day.
We need an incentive to invite more members. There should be 60,000 or 600,000 or 6 million or more regularly participating. These are great prizes and great charities and this is a great and unique way of bringing charity and prize rewarding together.
However, I don't see it advertized anywhere, anymore and we members seem to be sitting on the info about it to maximize our own individual chances...
Maybe find a way to give an extra entry to anyone who gets someone else to sign up or a special monthly lottery-type prize to be awarded to one of the members that had others sign up that month. I don't know... A site this great should have more members and much faster growth!

That's a good idea, but the risk of abuse is very high, many game trading sites offer credit for referrals and the systems are highly abused even if credit card and physical addresses are required at sign up; this kind of site only requires an e-mail address which can be created easily so it's risky to implement.

Why do you need an incentive to care?
I started out my life participating in organizations that put forth, but rarely get proper recognition back.
I chose a career that puts me in the "limelight" for charity events, but that's not why I chose it.
My son and I have gotten an awful lot of people to sign up. How many of those got others to sign up, I do not know.
This is like knowledge. It's something to be shared, not horded.

I agree with you. However the slow growth here shows that altruism is not the general case here.
Many, if not most are here to win prizes first and help charities without any monetary expenditure or real effort second.
If that is the reality, (and I believe it is) then an extra incentive may be needed to get members to make their personal odds of winning less.

I'm just trying to be realistic. I want the site to succeed.

@donnaou All my friends have dropped this site and it's mostly due to the boards. The math is easy for anyone. An average of 18-19 tickets a day for the X-box over a 165 day time period?! How about 22-23 tickets a day over 37 days for a Holiday Coach Bag?! That's just outrageous. No wonder member participation is so ridiculously low. It's like calling in for years to your radio station trying to win some prize. Then the news informs you that there's people out there with multiple phone lines out there that want to insure their win. What's the point in calling in if they're hoarding all the phone lines?

Unfortunately I agree. People are swaying the odds. Also unfortunately, it is very easy to cheat. Raffstar, if you want to know how, please email me. There are a few simple ways to kill the cheaters. Give the charities more money by getting more people to this site. (Along with the rest of us (whom are KILLING OURSELVES) an honest chance.) (sorry to harp...)

Wow! I can't believe the comments here.......My feelings are hhurt and I just started here. I set my alarm clock every hour so i can enter this and other contests. Might as well I'm up peeing about once at least every hour LOL just want to let you know so you don't think I'm cheating if I ever get alot of entries in. I don't see how you could cheat. Oh well I just as checkng to see who won! Congrats to the winner of the Amazon gift certificate! I know peoople who staayed up all day and night to n a hot do key chain LOL an they weren't cheating! It's just a esre to win and once you win you get addicted to entering that's all it is and some people don't have little ones or others to take care of and maybe are barely gettng by and this is a healthy way to pass time especially to those who aren't able to get out! GLTA!

If it is honest Donnaou, great. I do the same thing with the alarm clock. I set the clock, come in to my puter, and click on the next set of tickets. However, getting 22-24 tickets per day for 150 days in a row is highly unlikely. Especially when there is very easy ways to cheat this system. I am killing myself to get this xbox (as I am in 3rd currently) but other people getting multiple accounts using bots (presumably) is putting most everyone off. I am just saying that a few minor fixes to the site could completely kill the botters. Then more people will come to the site and more charities and advertisers will also. I want Raffstar to work!!! So, to the fair ones not cheating, EXCELLENT! To the botters, shame shame... lol.

Oh yeah, the Wii in between the 360's. Worked hard for that one too. To the newbie, good luck! I have found that sleep deprivation just isn't worth it. You'll see the novelty wear off when you start cringing at the color yellow. LOL!

I just got up to get my hourly entry in and I think I'm not going to read these comments anymore. Sounds like a bunch of kids complaining no matter what nothing will make everyone happy. I'm going to mind my own business but will express I don't like hearing all the negativity towards other people whom you don't even know for sure what they are doing makes everyone sound jealous. Sorry but I don't like it when people butt into other peoples business and we are a free country and have a right to enter every hour on this contest without being called cheaters. I feel like trying to get an entry in for every hour just to get my metabolism going by not sleeping all day long and not moving around to help me lose weight which would help me in alot of other ways too but I don't want to bore everyone with my reasons to want to try to get an entry in every hour to win this for my son I have chronic pain and it's very very painful nerve pain and this kinds helps keep my mind off of crying and if I could win it would be sooooooo cooooool! Good bye all I'm just going to enter and not read the boards they kinda put a damper on things and sound negative and I want to stay positive!

Wow, this has been going on for a while, but I want to chime in on a few things:

1, please sleep about 8 hours a day, it helps your immune system...yeah it's 4AM here, but I'll be sleeping in until about noon.

2, I have also had the button not loading problem, clearing my cache seems to help. (I don't think the Wii does that, but all PC and Mac browsers do)

3, I love my PS3...which is why I'm awake at 4 AM in the first place.

Although I suppose I am avging 14-17 tickets per day. I start in the morning, boot up the puter, get some coffee, log in, click, set an alarm, then get to work. I continue with the alarm getting tickets at night. Sometimes I miss but I am pretty consistent.

Yeah I sleep occasionally. Unfortunately I get insomnia and only get a few hours sleep a few times a night. I am not in the mood to get up on the puter and click for tickets though. I rather just lay there pointlessly. lol.
